(b): The companies that are supplying urea to Andhra Pradesh and Telangana are GSFC (Gujarat State Fertilizers & Chemicals Ltd.) - Baroda Plant, KRIBHCO (Krishak Bharati Co-operative Ltd.) – Hazira Plant, MCFL (Mangalore Chemicals and Fertilizers Ltd.) – Mangalore Plant, MFL (Madras Fertilizers Ltd.) – Chennai Plant, NFCL (Nagarjuna Fertilizers & Chemicals Ltd.) – Kakinada Plant, NFL (National Fertilizers Limited) – Vijaypur Plant, RCF (Rashtriya Chemicals and Fertilizers Ltd.) – Thal & Trombay, SPIC (Southern Petrochemical Industries Corp. Ltd.) - Tuticorin, ZACL (Zuari Agro Chemicals) - Goa, IPL (Indian Potash Limited) and CIL (Coromandel International Limited).

These two States also get Urea supplies from the following ports (companies): New Mangalore (IPL), Jaigarh (NBCL), Tuticorin (IPL), Karaikal (IFFCO), Chennai (IPL), Kakinada (IFFCO), Krishnapatnam (CIL), PICT/Paradip (NFL), Gopalpur (IPL), Gangavaram (IPL), Kamrajar/Ennore (IFFCO), Dhamra (IPL) and Vizag (NFL).

(b) if so, the details thereof and the number of such cases registered and the action taken against the people found involved in such activities along with the revenue loss suffered by the States/Union Territories on that count during each of the last three years and the current year;

(c) whether the Government proposes to make the use of neem coated urea compulsory for agro purposes, if so, the details thereof and the present status of the said proposal;

(d) whether the Government proposes to produce cent percent subsidised neem coated urea in the country and if so, the percentage of urea being coated with neem presently; and

(e) the date by which cent percent neem coated urea is likely to be made available in the market at subsidised rates?

(a) & (b): Sir, Government of India has declared fertilizer as an essential commodity under the Essential Commodities Act, 1955 and notified Fertilizer Control Order (FCO), 1985 and Fertilizer (Movement Control) Order, 1973. The State Governments have been empowered to take appropriate action to curb Black-Marketing and Diversion of Subsidised Urea to Industrial Sector and to conduct search, make seizures and take punitive action against any person violating provisions of FCO, 1985 and Essential Commodities Act, 1955.

The number of cases of diversion reported by various State Governments in the last three year and current year is as follows:

In all these cases, State Governments have taken appropriate actions as per FCO. Information on revenue loss is not available with the States as reported by State Government.

(c) to (e): Based on CCEA decision, vide notification dated 25th May, 2015 Department of Fertilizers had made it mandatory for all the domestic producers of urea to produce 100% as Neem Coated Urea. Entire quantity of indigenous urea and imported urea is being neem coated w.e.f 1st September, 2015 and 1st December, 2015 respectively.

Whether the Government has made any assessment of the quantum of damage to environment caused by pollution in the country;

(a) to (d) Methodologies have been developed for evaluating environmental compensation to be levied on the person/authority responsible for environmental pollution in respect of certain categories. These cover violations by industrial units, violations of Graded Response Action Plan (GRAP), NCR-Delhi, untreated discharge of sewage by concerned individual/authority, and non-compliance of Solid Waste Management Rules, 2016 by concerned municipal authority (Annexure-I). Based on it, Central Pollution Control Board has imposed Rs 52.63 crore as environmental compensation on non-complying industries.

(b) whether the Government is aware that the callous attitude of authorities is one of the main reasons for the said spike in pollution levels and if so, the details thereof;
(c) whether the Government has put any mechanism in place to fix the accountabilities on the authorities concerned for the irregularities and illegalities committed by them and if so, the details thereof; and
(d) the steps taken by the Government to ensure the strict implementation of the rules in this regard specially in Jharkhand?

(a) & (b) Analysis of last five-year ambient air quality data (2014-2018) indicated that most of the cities were within the National Standards with respect to parameters of SO2 and NO2. With respect to PM10 and PM2.5, 18 and 12 cities respectively showed decreasing trend. In reference to Delhi, there has been an overall improvement in air quality of Delhi in 2019 as compared to that of 2016. The number of ‘Good to ‘Moderate’ days has increased to 175 in 2019 as compared to 108 in 2016.

(c) CPCB and SPCBs are vested with powers under The Air (Prevention and Control of Pollution) Act and under the Environment (Protection) Act, , 1986 to issue directions for the closure, prohibition or regulation of any industry, operation or process; or stoppage or regulation of the supply of electricity or water or any other service, for protection of the environment

(d) Ministry of Environment, Forest and Climate Change (MoEF&CC) has launched National Clean Air Programme (NCAP) as a long-term, time-bound, national level strategy to tackle the air pollution problem caused by various sources which inter-alia includes vehicular emissions, industrial emission, dust, garbage dumping, burning of Municipal waste/industrial waste etc. across the country in a comprehensive manner. Under NCAP, 102 non-attainment cities including Dhanbad in Jharkhand have been identified based on ambient air quality data for the period 2011 – 2015 and WHO report 2014/2018. Out of 102 non-attainment cities identified under NCAP, for the cities with million plus population and PM10>90µg/m³, Ministry of Environment, Forest & Climate Change is funding ?10 Crores in the current year for 28 such priority cities, including Dhanbad in Jharkhand, for various components that, inter-alia, include Installation and commissioning of CAAQMS, Creating green buffer zone along the roads, Mechanical street sweeper, Mobile Enforcement Unit, Public awareness and capacity building activities, Water sprinkler.

The names of the projects being run by the Government for conservation of environment in the country along with the amount of funds spent on the said projects

STATEMENT REFFERED TO IN REPLY TO PARTS (a) TO (d) OF THE LOK SABHA STARRED QUESTION NO. 268 BY SHRI ANIL FIROJIYA REGARDING ‘CONSERVATION OF ENVIRONMENT’ DUE FOR REPLY ON 06-12-2019.

(a) The Government is implementing various Centrally Sponsored Umbrella schemes namely National Mission for a Green India, Integrated Development of Wildlife Habitats, Conservation of Natural Resources & Ecosystems, National River Conservation Programme and Compensatory Afforestation Programme of Ministry of Environment, Forest and Climate Change (MoEF&CC). A sum of Rs. 11,254.00 crores (including Rs. 8,562.73 crores under CAMPA) have been released by MoEF&CC during the last three years i.e. 2016-17 to 2018-19 to conserve environment. The State wise details of funds spent under various schemes/programmes is placed at Annexure-A.
(b) As per the India State of Forest Report (ISFR), 2017, there has been an increase of 1243 sq. km in the tree cover on the country as compared to ISFR, 2015. This is mainly attributed to large scale plantation by different Government and private agencies and farmers outside forest area. Tree cover of the country as per ISFR, 2013, 2015 and 2017 are 91,266 sq. km (2.78% of Geographical Area), 92.572 sq. km (2.82% of Geographical Area) and 93, 815 sq. km (2.85% of Geographical Area) respectively. This shows an increasing trend of tree cover in the country. Government’s policy is to ensure that more trees are planted than trees removed for any public or utility projects.
(c) National Forestry Policy, 1988 envisages a national goal to have a minimum of one-third of the total land area of the country under forest or tree cover. However, the actual number of trees planted is dependent on the Annual Plan of Operation finalized by the individual State Government based on their own planning for each financial year. To achieve this goal, afforestation programmes are being taken up under various Centrally Sponsored Schemes and States/UTs Schemes/Plan.
(d) Government of India has adequate policies/programmes and initiatives for conservation of environment in Cities like Nagar Van Yojana, National Clean Air Programme (NCAP), Pradhan Mantri Ujjwala Yojna (PMUY), National Solar Mission, Smart Cities Mission, Green Highway Policy, National Green Aviation Policy, National Water Mission, Jal Jeevan Mission, Jal Shakti Abhiyan, Swachh Bharat Mission and National Electric Mobility Mission Plan (NEMMP) with a vision for providing wholesome living environment, and contributing to smart, clean, green and sustainable cities for healthy and happy citizens.

• launching of Single-Window Integrated Environmental Management System named PARIVESH (Pro-Active and Responsive facilitation by Interactive, Virtuous and Environmental Single-window Hub) for complete online, expeditious and transparent system for environment, forest, wildlife and CRZ clearances in the country;
• adoption of standard Terms of Reference;
• flexibility in collection of baseline data;
• formulation of standard environmental clearance conditions;
• delegation of more number of projects or activities to state level authorities and regional authorities;
• alert through SMS to the project proponents;
• re-engineering / modification several business processes for ease of citizens and project proponents;
• special dispensation for the projects of national importance and for projects related to defence and country’s security;
• notification of procedure to appraise / approve projects which started / expanded without prior EC, as a onetime measure; etc.

(a)to (c) No, Sir. The Government has not formulated any scheme to carry out third party monitoring by fixing corporate responsibility towards the conservation of the environment. The Central Sector Schemes of the Ministry of Environment, Forest and Climate Change are to be evaluated through Third Parties on the completion of the 3 year Finance Commission cycle period of the Fourteenth Finance Commission from 2017-18 to 2019-20, which includes the Schemes pertaining to the Conservation of Environment. The Centrally Sponsored Schemes implemented by the Ministry are being evaluated by a Third Party engaged by NITI Aayog, for all the Centrally Sponsored Schemes of the Government.

Further, for improving the compliance status of the implementation of the environmental clearance conditions of the projects and activities for which Environment Clearance (EC) are being issued by the Ministry of Environment, Forest and Climate change and the State Environment Impact Assessment Authority (SEIAA), the Government had issued a draft Notification S.O. 4721(E) dated 10.09.2018 to introduce the concept of randomised third party compliance monitoring of the ECs conditions through national level reputed and competent government institutions.

However, in light of Hon’ble NGT order dated 29.04.2019 in OA No. 837/2018, the notification dated 10.09.2018 has been kept in abeyance and a separate Monitoring Action Plan has been finalised for improving the compliance of environmental conditions by involving, strengthening and expansion of Regional Offices, SEIAAs, Central Pollution Control Board (CPCB), and State Pollution Control Boards (SPCBs). The same has been submitted to the Hon’ble NGT.
