Compliance Management System (CMS)
CMS encompasses a company's documented systematic efforts to diligently prevent, detect, and correct violations through the following means:
  • Written standards and procedures that describe how employees and other company representatives will meet statutory, regulatory, and permit requirements, as well as the conditions of other enforceable agreements
  • Assignment of overall responsibility for overseeing the organization's compliance with standards and procedures, and assignment of responsibility at the individual facility or operations levels
  • Mechanisms for systematically ensuring that compliance and policy procedures are followed, including monitoring the systems designed to detect and correct violations, including a means for employees to report violations
  • Efforts to communicate standards and procedures to all employees and company representatives
  • Incentives to employees to act according to compliance standards and procedures, including disciplinary mechanisms
  • Procedures for the prompt correction of any violations and for modifications to the CMS to prevent future violations
