Imp clauses regarding Hazardous Wastes (Management and Handling) Rules, 1989

 Here are some important clauses from the Hazardous Wastes (Management and Handling) Rules, 1989:

Import and export

Hazardous wastes can only be imported into India for recycling, reuse, or recovery. Exports are only permitted to an operator of a disposal facility or an actual user of the waste, with prior consent from the importing country. 

Packaging, labeling, and transport

Hazardous wastes must be packaged, labeled, and transported in accordance with the rules of the Central Government under the Motor Vehicles Act, 1988. 

Environmental impact assessment

The operator, occupier, or association of occupiers of a facility must conduct an environmental impact assessment (EIA) of the site for treatment, storage, or disposal of hazardous wastes. The EIA report must be submitted to the State Pollution Control Board or Committee. 

Liability

The occupier, importer, exporter, and operator of the disposal facility are liable for any damages caused to the environment or third parties due to improper management or handling of hazardous waste. 

Records

The person importing hazardous wastes must maintain records of the imported wastes as specified in Form 7. These records must be open for inspection by the State Pollution Control Board or Committee, the Ministry of Environment and Forests, or an officer appointed by them. 

Safety

The persons working on the site must be provided with information, training, and equipment to ensure their safety

Waste that is dangerous to the environment or health due to its physical, chemical, biological, reactive, toxic, flammable, explosive, or corrosive properties.

Prioritizes waste prevention, followed by reuse, recycling, recovery, and finally disposal. 

Hazardous waste management methods

Includes landfilling, waste-to-energy, hydrothermal treatment, washing and extraction, phytoremediation, bioremediation, sintering and melting, cement rotary kilns coprocessing, and advanced oxidation and photocatalysis. 

Hazardous waste import and export

India only imports hazardous waste for recycling, reuse, or other utilization. The importer must have environmentally sound facilities and adequate arrangements for the treatment of wastes. 

Hazardous waste management rules

These rules ensure the safe handling, generation, processing, treatment, packaging, storage, transportation, use, reprocessing, collection, conversion, and offering for sale, destruction, and disposal of hazardous waste. 

Hazardous waste records

Importers of hazardous waste must maintain records of the imported wastes as specified in Form 7. These records are open for inspection by the State Pollution Control Board or

 Committee.
